- We
shall provide you with a sample layout for the interior of a typical Big Mama’s
& Papa’s Pizzeria of the type you have selected. You shall, at
your sole expense, approved by BMPP employ architects, designers, engineers or
others as may be necessary to complete, adapt, modify or substitute the sample
plans and specifications for the Pizzeria.
- You shall submit a complete set of final plans and
specifications to us prior to commencing construction of the Pizzeria.
- We shall review such plans and specifications promptly and
approve provide comments on the plans and specifications to you.
- You shall not commence construction of the Pizzeria until
we approve in writing the final plans and specifications to be used in
constructing the Pizzeria.
- We shall consult with you, to the extent you deem
necessary, on the construction and equipping of the Pizzeria, but it shall be
and remain your sole responsibility to deal with the vendors, diligently
design, construct, equip and otherwise ready and open the Pizzeria.
- You will be responsible, at your expense, for obtaining all
zoning classifications, permits, clearances, certificates of occupancy and
center clearances which may be required by governmental authorities.
- You shall use licensed general contractors, designers and
architects as approved by us prior to performing construction work at the Big
Mama’s & Papa’s Pizzeria
restaurant. - We expressly disclaim any warranty of the quality or
merchantability of any goods or services provided by architects, contractors,
equipment from vendors or any other persons or entities to which we may refer
you.
- We shall not be responsible for delays in the construction,
equipping or decoration of the Pizzeria or for any loss resulting from the
Pizzeria design or construction since we have no control over the landlord or
developer and numerous construction and related problems which could occur and
delay the opening of Your Pizzeria.
- We must approve in writing any and all changes to the
Pizzeria plans prior to
construction of the Pizzeria or the implementation of such changes. - We shall have access to the Franchise Location while work
is in progress and may require such reasonable alterations or modifications of
the construction of the Pizzeria that we deem necessary.
- Your failure to promptly commence the design, construction,
equipping and
opening of the Pizzeria with due diligence shall be grounds for the termination
of this Agreement. - The date the Pizzeria actually opens for business as a Big
Mama’s & Papa’s
Pizzeria restaurant is the “Opening Date.”
